Off the shores of Hawaii in the South Pacific Ocean last week, ocean photographer Marco Queral was captured by a fellow diver playing with a 50-foot humpback whale.

I think I would be scared to death if I came across a 50-foot humpback whale while swimming in the ocean. Fascinating photo though!

Can you confirm that you have paid an agency for the use of the picture(s) of the whale and diver? We have agents around the world that you might have accessed these pictures through over the last week.

If not then I am afraid you are breaching copyright – this is an international law relating to rights managed pictures. Newspapers pay a lot of money to use these pictures and an extra fee for web use.

Having had the picture(s) on your site you will need to pay a fee of £45. Since you may not have known about this breach of copyright we have an offer for you: Contact us about payment within 24 hours and we will accept £20. This is not a scam this plays entirely in your favour.

    Yours sincerely,
