I had no idea about this legal battle until just recently, but it looks like photographer Jay Maisel (who you may recall lives in a 72-room mansion on Bowery) and his legal team managed to wrangle a whopping $32,500 from Andy Baio of Waxy.org back in September forĀ re-appropriatingĀ a photo of Miles Davis [taken by Maisel] into an 8-bit graphic for use in an 8-bit chiptune mixtape called Kind of Bloop.
Jay Maisel is a dick. I can’t describe him in any other words after reading about this whole ordeal from Andy who I wholeheartedly respect for his courage and determination throughout this situation. From here on out, I will not support Jay Maisel in any creative endeavors he takes on and I really hope that others follow me in doing so as well.
Andy is a good guy and he’s the last person who deserved this. Read his argument here and show some support.

You people are retarded, and obviously have no idea what you are talking about when it comes to copy write infringement… Baio knew he had to get permission from Jay Maisel to use the image in any way before he used it but did not so therefore is subject to such a lawsuit. Money, mansions, boats, whatever have nothing to do with it!!! The image could have been taken by anyone and as long as they registered the image then that person would have the legal right to sue if the image was used without permission. If you were real artists and knew half of what the law determines you might rethink your decision and NOT support Baio and others like him who take whats not their’s!!!

1. It’s spelled “copyright”.
2. You do not need to register an image to have it protected by copyright law.
3. You do not need to get permission to make fair use of a copyrighted artwork.
4. Real artists create art to express themselves, not to extort money from people.
Copyright law is completely out of control. We need to publicize these abuses as far and wide as possible. Most people aren’t aware of the issues, or have troubled understanding their rights. We need the support of large numbers of people if we ever hope to reform this broken system.
I don’t know if you’re a dick but you don’t know sh$t about copyright. Derivative work. Not even close to a “fair use” defense.
I guess the questions comes down to “what if the photo was yours and someone else used it to profit their work, or expand their portfolio?”
What ever jay has, is his because of his work or the time hes put in as a photographer or anything else he does as income.
That was his photo, if the artist wanted to be artistic, he could have used that a a foundation for his artwork, not re-render the photo and call it art.
If this happened with one of my photos, i know id be upset as well.
